How do I know if a new law affects my business?

A new law affects your small business if it covers your location, your industry or what you sell, and a business of your size. Read the official summary for who it applies to and when it takes effect. Many state laws start on January 1 or July 1, and some labor laws apply only above a number of employees. If you are still unsure, ask your trade association, accountant or attorney before the effective date.

Five questions to ask about any new law for your business

  • Where does it apply? A city ordinance covers only that city. A state law covers the state, and federal law covers everyone.
  • Who does it cover? Look for the industries, products or activities it names.
  • Does my size matter? Some laws apply only above a number of employees or a level of sales.
  • When does it take effect? Laws often pass months before they start, and parts can start on different dates.
  • What do I have to do? Find the specific action: register, renew, post a notice, change a product, train staff or file something new.

Why employee count matters

Many workplace laws only apply once you reach a certain number of employees. Under federal law, for example, the Americans with Disabilities Act employment rules and Title VII of the Civil Rights Act apply to employers with 15 or more employees, and the Family and Medical Leave Act to those with 50 or more. States often set their own, lower thresholds, so check your state too.

Where to find a plain summary

  • The official bill summary on your state legislature’s website, which states who is covered and when it starts.
  • The agency that will enforce it, which often posts guidance and frequently asked questions.
  • Your trade association or chamber of commerce, which summarizes laws for members.
  • Your accountant or attorney, when money or penalties are involved.

Common questions

When do new laws take effect?

On the date the law sets. Many state laws start on January 1 or July 1, and some start the day they are signed. The bill text or the official summary lists the effective date.

Do new labor laws apply to businesses with few employees?

Some do and some don’t. Many federal workplace laws apply only once you have 15 or 50 employees, while others, such as most minimum wage rules, cover nearly every employer. Check the law’s coverage section for its threshold.

Where can I find new laws for my state?

On your state legislature’s website, which lists the bills passed each session with their effective dates. Many states also publish a list of new laws before January 1 or July 1, and state agencies post guidance for the laws they enforce.
